Under Section 40A of the Gas Act, 1976 (inserted pursuant to Article 20 of the European Communities (Environmental Impact Assessment) Regulations 1989 (SI 349 of 1989) an applicant is required to furnish copies of the Environmental Impact Statement (EIS) indicating that observations should be submitted to the Minister for Communications, Energy and Natural Resources within the statutory period of one month. The prescribed bodies include the Department of Environment, Heritage and Local Government (DEHLG).
If further material, which is considered to contain significant additional information in relation to the effects on the environment of the pipeline is submitted subsequent to the publication of the notices above, the developer will be required to:
(i) publish in both local and national press, a notice stating that significant further information in relation to the said effects has been furnished to the Minister, that the further information will be available for inspection, free of charge or for purchase, at a specified site and at specified times during a specified period, and that submission or observations in relation to the further information may be made in writing to the Minister before expiry of the specified period
(ii) send notice of the furnishing to the Minister of significant further information, and a copy of the further information, to the prescribed bodies to indicate to these bodies that submissions or observations in relation to the further information may be made in writing to the Minister before the specified date.
