​7/2/2017 - I have received detail and breakdown of funds allocated to Irish Environment Network (IEN ) over last 6 years.
Further information required and outstanding remains requested but withheld and so I must turn to Taoiseach Dept. ( for details of oversight ) , DCCE (as grantor for oversight and appeals) , DAFM (considering funding/EMFF ) and DPER (confirmation of compliance of all as grantor/grantees....transparency and appeals process). The secrecy and lack of transparency and accountability is mind boggling , when IEN/EP, advocates of Aarhus, grantees of public funds, are exempt from OIC......

I still require the identities of the assessors and any Government officials in process of distribution as these identities are withheld by IEN and appeals process precluded by IEN .
I require minutes of any such agreement or decision.
In the breakdowns please advise specifically on funds directed to Environmental Pillar (EP) and ELIG.....this needs directing to Taoiseach's Dept., which  requires oversight of rules of  EP and ELIG composition.
Please advise of mechanism, whereby funds allocated a legal entity (IEN) are channelled to non-legal entity/ies , how they are accounted for and minuted decisions to such effect.
As further funds are about to be approved and more under consideration and not to delay core funding to rightful grantees it is important these requests and info are provided now, with assurance of good governance. This is not presently the case,

All records of any kind in connection with or relating to the calculation methodology in Paragraph 4.8 and/or Paragraph 4.9 of Decision Paper CER/08/236 Calculation of the R-Factor in determining the Public Service Obligation Levy dated 20 November 2008, whether such records relating to the development of such methodology prior to the date of CER/08/236 or whether they post date CER/08/236.
3. All records of any kind in connection with discharge by the Minister of his duty pursuant to Section 39(5)(a) of the ERA, including any records of any kind in relation to obligations of the Minister thereunder.

I propose to take Questions Nos 403, 404 and 405 together.


At the time of the Electronic Commerce Act, as the Act states, it was decided to exclude deeds of transfer, family home declarations and other sworn declarations, (as technology and the availability of it) were yet not fit for that purpose, adequate procedures and practices had not yet been developed in public registration or other services, and it was not in the public interest to do so at the time.
Any plan to amend legislation to allow eSignatures for property related transactions would require careful consideration, including taking into account relevant legal, tax, business, property and title registration issues, including IT interoperability aspects. 
The matter of eConveyancing is of course a matter for the Department of Justice. I understand that while a  proposal in relation to eConveyancing received some consideration by a review group convened by the Department of Justice and Equality in early 2016, this proposal was subsequently withdrawn and there is no alternative proposal currently under consideration.

​FOI/2017/193​Client21/12/2017 - ​We represent Mr Bernard McDonagh and his wife Mrs Helen McDonagh of Ashline, Ennis in County Clare who are members of the travelling community. They are the only defendants in a case before The High Court (record number 2017/11402P). The case relates to a dispute between the parties as to the entitlements of the McDonagh family to continue to occupy the site of Ashline in Ennis. Clare County Council say that we are trespassers and seek a Court order to evict our clients from the lands they occupy. We say that our clients have tenancy rights and that Clare County Council seek to assimilate the traveller population and do not uphold their rights to traveller specific accommodation. This case is one of absolute urgency and is returnable to 11th of January 2018 but we must respond by 4th of January to Clare County Council.
Therefore we seek the following by way of the entitlements of our client’s under the Freedom of Information Act;
