Priority request
1. For the period from 1st April 2017 – 20 March 2018, please provide all correspondence between the Department (and its advisors and representatives) and any third parties, and any other relevant papers or briefing notes, in relation to the lawfulness (or otherwise) of the implementation of a nationwide smoky coal ban.
Supplementary requests
For the period from 1st April 2017 – 20 March 2018, please provide:
1. Copies of all submissions or correspondence received by the Department in relation to the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone).
2. Copies of all correspondence sent by the Department in relation to the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone).
3. Copies of all memoranda, notes, meeting minutes and internal correspondence within the Department in relating to the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone).
4. Details of any meeting requests to the Minister or the Department in relation to the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone).
5. Details of any meetings held in relation to the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone).
6. Copies of any briefing notes prepared for the Minister or their officials regarding the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone).
7. Details of any submissions or correspondence in relation to the Air Pollution Act and or the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone) from any public bodies or statutory agencies.
8. Details of all correspondence, notes, minutes, written or digital records between the Department and any other Government Department, state agency or the European Commission concerning the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone) or the Air Pollution Act.
9. Details of any parliamentary or legislative queries regarding the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone).
10. Details of all correspondence from the European Commission and or other European agencies concerning the implementation of a nationwide smoky coal ban (the Nationwide Low Smoke Zone) or the Air Pollution Act, including details of any competition issues that may arise.
Clarification received 17/04/2019
We do not need general letters from members of the public and Departmental responses generally on the smoky coal ban.  We do not need parliamentary questions and responses.

As you indicate in your last paragraph, we were interested in just the more narrow issue of any third party correspondence and papers or briefing notes in relation to the lawfulness (or otherwise) of the implementation of a nationwide smoky coal ban (and which we understand has led to the recent decision not to implement a nationwide ban for the coming heating season of 19/20).

This request refers to the Department's "High Speed Broadband Map – Supplementary Information Request" dated 27 March, 2015. Pursuant to this process a decision was made to remove 300k premises from the intervention area following the provision of "concrete" business plans by Eircom Ltd to roll-out High Speed broadband in this footprint on a commercial basis.

In this context, and under the Freedom of Information Act 2014, I request the following records:

-. A copy of all documents (including any emails, minutes of meetings, Excel based costing files, memos etc) that the Department shared with the Commission for Communications Regulation ("ComReg") as part of, and subsequent to, this process, including documents that were provided by Eircom Ltd and those produced by the Department with respect to this matter, up to, including, and subsequent to the signing of the "Eir Commitment Agreement", between The Minister for Communications, Climate Action and Environment and Eircom Limited in April 2017.
-. Any communications (including any advice) received from ComReg in relation to this process up to and including the signing of the Commitment Agreement between Eircom Ltd and the Minister.
-. Details of any discussions (including any emails, minutes of meetings, memos etc) held between the Department and Eircom Ltd during the process which dealt with assumptions/risks around wholesale and retail pricing in the 300k area and in particular the level of wholesale connection and rental charges.

My request concerns the later of the two assessments- 2016/2017.

I am looking for records between July 2016 and December 2017.

-briefing notes and speaking notes for coreper and council meetings
-research and impact assessments (if there were any)
